Terms of Service

Effective October 4, 2026

These terms are the agreement between you and Goings Social (“we” and “us”) about using Goings, our iPhone app, and this website. By creating an account or using Goings, you agree to them and to our Privacy Policy. If you don’t agree, please don’t use Goings. Questions go to sam@flareme.xyz.

The short version

  • You must be 13 or older. If you’re under 18, a parent or guardian has to be okay with it.
  • Goings is for real events and real people. Don’t fake where you are and don’t post things that hurt people.
  • You own what you post. You let Goings show it to others so the app can work.
  • Meeting people in real life carries real risk. Use good judgment.
  • We can remove content and accounts that break these rules. You can delete your account any time.

1. Who can use Goings

You must be at least 13 years old to use Goings, and you must give us your real birthday when you sign up. If you’re under 18, you may use Goings only with the permission of a parent or guardian, who agrees to these terms for you. You can’t use Goings if you’ve been banned from it, or if the law where you live doesn’t allow it.

2. Your account

Give us accurate information, keep your password private, and don’t share your account. You’re responsible for what happens on it. We confirm your email with a six-digit code. If you think someone else has gotten into your account, change your password and email us. You may have one account.

3. How Goings works

A Link is a temporary space built around something happening at a real place. Anyone signed in can browse Links and follow along from anywhere. To join a Link or post in it, you need to be within three miles of it, and we check your approximate location to enforce that. Don’t fake or hide your location, use a tool to spoof it, or let someone else post from your account.

Some content from a Link that has ended, such as its recap, is limited to the people who attended.

Goings is an early product. Features may change, break or go away.

4. Your content

What you post is yours: photos, videos, text, comments, messages and anything else you put on Goings. You’re responsible for it. To let Goings work, you give us a worldwide, non-exclusive, royalty-free license to host, store, copy, resize, display and distribute your content inside Goings, including to other users and through shared recap links you create. The license lasts while your content is on Goings. It ends when you delete the content or your account, except for copies that other people have legitimately kept, and except for limited records we keep for safety or legal reasons as described in our Privacy Policy.

You promise that you have the right to post what you post, and that it doesn’t break the law or anyone else’s rights. Before you post a photo or video of someone, make sure they’re fine with it. Be especially careful with people under 18.

5. Community rules

Don’t use Goings to post, share or do any of the following:

  • Anything illegal, or anything that encourages illegal activity.
  • Sexual content involving anyone under 18. We have zero tolerance, remove it, and report it to the authorities. Don’t post sexual or pornographic content at all.
  • Harassment, bullying, hate, or threats of violence, including encouraging someone to hurt themselves.
  • Violence, dangerous stunts or gatherings that put people at risk.
  • Other people’s private information, including where someone lives or is right now without their say-so.
  • Pretending to be another person, business or organization.
  • Spam, scams, or fake Links that mislead people about what’s happening or where.
  • Selling or promoting illegal goods or services.
  • Viruses, scraping, automated account creation, or anything meant to disrupt Goings or get around our safety features.

6. Meeting people and going to events

Goings helps you find real events and the people around them. We don’t organize, host, supervise or check the events, venues or the people who attend, unless an account is marked verified, and that mark doesn’t make an event safe. You go to events and meet people at your own risk. Use good judgment: meet in public places, tell a friend where you’re going, leave if something feels off, follow the law and the venue’s rules, and never use your phone while driving. We’re not responsible for what other users or event hosts do, online or in person.

7. Reports, moderation and enforcement

You can report people, posts, comments, messages and Links from the menu, and you can block anyone. Reports are reviewed by our staff. We can remove content, limit features, suspend or ban accounts, or end a Link when we think these terms have been broken or someone could be harmed, and we may do it without notice when safety requires it. If you think we got something wrong, email us and we’ll take another look. We may share information with law enforcement or others when the law requires it, or to respond to an emergency.

8. Verified accounts

A verified mark means we reviewed a request from that account, for example from an artist, venue, school or organizer. It isn’t an endorsement, and it doesn’t guarantee anything about the account’s content or events.

9. Shared recap links

If you create a link for a month or a year, anyone who has it can see your display name, username, avatar, a few counts and up to 24 of your photos from that period. You decide whether to create it and who gets it, and you can stop sharing at any time from the share screen. Once you stop, the link stops working, though we can’t take back anything someone already saved.

10. Our rights

Goings, including its name, logo, design and code, belongs to us and our licensors. We give you a personal, non-exclusive, revocable license to use the Goings app on your own Apple devices, subject to these terms and Apple’s usage rules. You may not copy, modify, reverse engineer, or resell Goings, or use our name or branding without our permission. Goings includes open-source software that is covered by its own licenses. If you send us feedback or ideas, we may use them without owing you anything.

11. Copyright complaints

If you believe something on Goings infringes your copyright, email sam@flareme.xyz with: what the work is, where the content appears in Goings, your contact details, a statement that you believe in good faith that the use isn’t authorized, and a statement, under penalty of perjury, that your notice is accurate and that you’re the owner or authorized to act for the owner, plus your signature. We may remove the content and end the accounts of people who repeatedly infringe.

12. Ending your account

You can delete your account at any time in Settings. We can suspend or end your account if you break these terms, if you put others at risk, or if we’re required to by law. What we do with your information afterward is described in the Privacy Policy. Sections that by their nature should survive, such as the license for content others already saved, the disclaimers, the limits on liability and the rules about disputes, will survive.

13. Disclaimers

Goings is provided “as is” and “as available.” To the fullest extent the law allows, we make no promises that Goings will always be available, error-free or secure, or that what other users post is accurate, safe or legal, and we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. Some places don’t allow certain disclaimers, so some of this may not apply to you.

14. Limits on liability

To the fullest extent the law allows, we’re not liable for indirect, incidental, special, consequential or punitive damages, or for lost data, lost profits or lost opportunities, arising from your use of Goings. We’re also not liable for what other users or event hosts do. Goings is free, so our total liability to you for any claim is limited to one hundred U.S. dollars ($100). Nothing in these terms limits liability that the law doesn’t allow us to limit.

15. Indemnity

To the extent the law allows, you agree to cover us for claims, losses and costs (including reasonable legal fees) that come from content you post or from your breaking these terms or someone’s rights. This doesn’t apply where the law doesn’t allow it for minors.

16. Disputes and governing law

If you have a problem, email us first at sam@flareme.xyz, and we’ll try to sort it out informally. These terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules, and any dispute we can’t resolve informally will be decided in the state or federal courts located in Texas, and you and we agree to those courts’ jurisdiction. If you’re a consumer, you also keep any rights you have under the laws of the place where you live that can’t be waived.

17. Apple

This agreement is between you and us, not Apple. Apple has no obligation to provide maintenance or support for Goings. If Goings fails to meet an applicable warranty, you may tell Apple and Apple will refund the purchase price, if any, and, to the extent the law allows, Apple has no other warranty obligation. Apple isn’t responsible for claims about Goings, including product liability, legal compliance, consumer protection or intellectual property claims. You confirm you aren’t in a country under a U.S. embargo and aren’t on a U.S. list of prohibited parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

18. Changes

We may update these terms. If a change is material, we’ll tell you in the app or by email before it takes effect. If you keep using Goings after that, you accept the new terms. If you don’t, you can delete your account.

19. The rest

These terms and the Privacy Policy are our whole agreement about Goings. If a part of them can’t be enforced, the rest still applies. If we don’t enforce something right away, we haven’t given up the right to. You can’t transfer your account or your rights under these terms to anyone else. We may transfer ours as part of a sale or merger.
